Terms of Service

Summary: Ospito manages your short-term rental property and pays you a percentage of revenue after our 20% management fee. You retain full ownership. We handle everything else.

1. Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Host") and Ospito, Inc. ("Ospito," "we," "us"). By creating an account or signing the management agreement, you agree to these Terms in full.

Ospito charges a management fee of 20% of gross rental revenue. This fee covers all services listed above. Additional fees may apply for maintenance, supplies, and repairs, which will be communicated to you in advance for amounts exceeding $200.

Ospito processes monthly payouts via Stripe Connect to your connected bank account on or around the 1st of each month for the prior month's earnings. A minimum balance of $50 is required for payout. Failed payouts are retried after 5 business days.

6. Term and Termination

The management agreement begins on the date you sign the agreement and continues month-to-month. Either party may terminate with 30 days written notice. Ospito may terminate immediately for material breach, fraudulent activity, or property safety violations.

7. Limitation of Liability

Ospito's liability is limited to fees paid in the preceding 3 months. Ospito is not liable for: platform cancellations, force majeure events, property damage beyond platform protections, or acts of guests.

8. Damage and Insurance

Ospito will assist in filing platform protection claims (Airbnb AirCover, VRBO Property Damage Protection) for documented damage. Hosts are responsible for maintaining appropriate homeowner's or landlord insurance.

9. Privacy

Your data is governed by our Privacy Policy. We do not sell your personal information to third parties.

10. Governing Law

These Terms are governed by the laws of the State of Texas. Disputes shall be resolved by binding arbitration in Austin, Texas.
